FORMATION DE BASE EN COURTAGE IMMOBILIER ET HYPOTHÉCAIRE

Brossard, le 28 novembre 2012 – L’Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) est heureux de l’annonce du ministère des Finances et de l’Économie du Québec de rendre obligatoire la formation de base pour tous les futurs courtiers immobiliers ou hypothécaires. À cet égard, tous les candidats qui se présenteront à un premier examen en courtage immobilier ou hypothécaire à compter du 1er septembre 2013 devront avoir suivi et réussi la formation dans un établissement d’enseignement accrédité par l’OACIQ.

« Dans un contexte où la vente ou l’achat d’une maison devient de plus en plus complexe, le courtier joue un rôle crucial dans le déroulement optimal de la transaction. L’annonce d’aujourd’hui est donc pour nous une excellente nouvelle », a souligné Robert Nadeau, président et chef de la direction de l’Organisme.

On se rappellera qu’avec l’entrée en vigueur de la nouvelle Loi sur le courtage immobilier en 2010, la formation de base avait cessé d’être obligatoire, bien que fortement recommandée par l’OACIQ.

« Cette formation de base nous donnera l’occasion d’encore mieux remplir notre mission de protection du public par l’encadrement et le maintien des compétences des courtiers, tout comme nous le faisons en offrant de nombreuses formations continues », a finalement affirmé le président et chef de la direction de l’Organisme, M. Robert Nadeau.

L'OACIQ a pour principale mission d'assurer la protection du public par l'encadrement et la surveillance des activités des courtiers conformément la Loi sur le courtage immobilier. Il contribue à promouvoir auprès du public le professionnalisme et la compétence des courtiers, notamment par la qualité de ses interventions en matière de formation de base et de formation continue. L'Organisme veille en outre au développement des meilleures pratiques en matière de courtage immobilier et hypothécaire au Québec.

Provincial regulators partner to increase consumer protection and improve mortgage broker standards

TORONTO, ON – (October 30, 2012) Mortgage broker regulators from across the country have partnered to establish the Mortgage Broker Regulators’ Council of Canada (MBRCC). Regulators from participating provinces now have a collaborative forum to improve consumer protection, develop national solutions to shared concerns and promote harmonization of Canada’s mortgage broker regulatory practices.

“It is critical to work more closely together now,” said Kirk Bacon, Chair of the MBRCC. “Mortgage risks are becoming increasingly prevalent, the market is growing more complex and many regulations need to be modernized to keep up.”

The partnership signals a new era of coordination and information sharing among regulators as well as a national approach to identifying and addressing issues in the mortgage broker industry.

The MBRCC strategic plan for 2012-2015 has also been released, outlining the strategic priorities and initiatives of the organization for this period.

One important initiative is the development of competency standards and curriculum requirements for mortgage brokers.

In addressing consumer protection concerns, the MBRCC committed to assessing practices that ensure mortgages are suitable and will also review the information consumers receive about the material risks involved in a mortgage.

“We believe the next three years will bring about positive changes not only to protect mortgage consumers in Canada, but also in industry standards and professionalism,” Bacon added. “The MBRCC looks forward to working closely with consumers, industry and other interested stakeholders in bringing these changes to fruition.”

About MBRCC

The MBRCC is an inter-jurisdictional association of mortgage broker regulators that seeks to improve and promote harmonization of mortgage broker regulatory practices to serve the public interest. Its members work together and with stakeholders to identify trends and address common regulatory issues through national solutions that support consumer protection and an open and fair marketplace.

MBRCC members represent the nine provinces that currently have legislative and regulatory frameworks governing mortgage brokers or have an interest in developing one; British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, New Brunswick, Nova Scotia and Newfoundland & Labrador.

Montréal (Québec), January 12, 2012 – In its judgment issued on November 28, 2011, the Court of Québec, presided by Ms. Nicole Martin, acquitted DuProprio Inc. of the six (6) charges laid against the company. Mindful of the impact such a decision may have on public protection, the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) will appeal the decision.a

“We have serious causes to believe that DuProprio has committed several infractions to the Real Estate Brokerage Act, said Mr. Robert Nadeau, President and CEO of the OACIQ, which is why we are appealing this decision”.

In its lawsuit initiated in 2009, the OACIQ contested DuProprio’s merchandising methods on the grounds that they led to believe that the company was authorized to perform real estate brokerage acts, despite having no accreditation to do so.

The Court of Québec’s decision reiterates the public order aspect of the Real Estate Brokerage Act and the necessity to protect the public. Unlike real estate brokers, DuProprio does not offer any of the protection provided under the Real Estate Brokerage Act.

“Consumers must have the assurance that the transaction in which they engage upon when purchasing a home is in accordance with the Act and that they benefit from all relevant protective mechanisms, concluded Mr. Nadeau. As such, we will strive to have the Superior Court of Québec overturn the judgment”.

The OACIQ’s main mission is to ensure public protection by supervising and overseeing the professional activities of real estate brokers in accordance with the Real Estate Brokerage Act. In this regard, it is responsible for applying the rules of professional conduct and conducting inspection of licence holders. The OACIQ also helps promoting brokers’ skills and professionalism among public, particularly by the quality of its trainings. In addition, the OACIQ ensures the development of best practices in real estate and mortgage brokerage in Quebec.

Brossard, June 15, 2011 – On June 10th, Mr. Serge Brousseau has been elected chairman of the board of directors of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ). Mr. Brousseau has a clear goal that he wants to achieve and speaks of it with conviction. "It is important to advertise and promote the work of brokers among the general public so that people deal with a real estate professional in a transaction as important as buying or selling a property or when applying for a mortgage loan", declared Mr. Brousseau after his election. He succeeds Mr. François Léger who has held the position for two years.

A long experience

Serge Brousseau has a solid experience of 25 years in real estate brokerage. In addition to developing his expertise on the field as broker first, then as manager of an establishment, Mr. Brousseau was a member of the board of directors of the Association des courtiers et agents immobiliers du Québec (ACAIQ) from 1996 to 2007. He was the vice-chairman of the board of directors from 1999 to 2001 and the chairman from 2001 to 2007. Serge Brousseau had also acted as the president of the Chambre immobilière du Grand Montréal from 1997 to 1998.

Composition of the board of directors

Note that eleven members constitute the OACIQ board of directors. Among them, eight are elected and three are appointed by the Minister of Finance. To read about the composition of the OACIQ board of directors, click here.

A new election for the chairman of the board position will be held next November for a one-year term. At the same time, the vice-chairman and the treasurer positions will be filled.

About the OACIQ

The OACIQ is responsible for the application of the Real Estate Brokerage Act in effect since May 1, 2010, and it ensures that this Act is complied with. The OACIQ upholds the mission of the Association des courtiers et agents immobiliers du Québec (ACAIQ), which began its activities in 1994, 40 years after the creation of the Corporation des courtiers en immeubles.

The mission of the OACIQ is to protect the public by supervising the professional activities of all real estate brokers and agents practicing in Québec. This mission enables the OACIQ to ensure the development of the real estate and mortgage brokerage best practices. While continuing to assume the responsibilities of the ACAIQ regarding the supervision of real estate brokerage activities as well as the maintenance and promotion of competence and integrity within the profession via its continuing education department, the OACIQ now holds additional powers, including that of acting as conciliator or mediator in a dispute between a broker or an agency and the client and that of arbitration of accounts between parties.
