Duties and Obligations of the Broker

The practice of real estate and mortgage brokerage is regulated in order to ensure that members of the public are protected when engaging in a real estate transaction through a broker’s intermediary. The rules and conditions of practice governing the profession are set out in the Real Estate Brokerage Act, the Regulations thereunder and the Rules of Professional Ethics. In the Notice of Disclosure, who is the "prospective contracting party"?

It is the person with whom the broker or the agent expects to conclude a purchase, sale or exchange contract.

As an experienced real estate agent, you know quite well that you must fill out a Notice of disclosure whenever there is a potential conflict of interest situation in any real estate transaction, whether you are acting in your professional capacity or not.

Amendments to the Real Estate Brokerage Act

(C.D.) This fall, there were amendments to the Real Estate Brokerage Act as the result of the coming into force of two other Acts: An Act respecting the distribution of financial products and services and An Act to harmonizing public statutes with the Civil Code.
