Real estate transactions: How to protect the most vulnerable clients

A real estate transaction is a stressful time in a person's life because of the substantial sums invested. There are also several factors that can help or hinder the success of a transaction.

When the transaction involves a vulnerable person, whether due to age, health or any other reason, the role of family caregivers and the real estate broker representing him becomes crucial.

In this context, the presence of a close relative or a legal representative, is valuable to support the person through the process and protect him from external pressures. The active involvement of close relatives helps him better understand the issues and avoid hasty decisions. This ensures that the vulnerable person's choices are made with full knowledge of the facts.

The real estate broker's role is also essential.  His main mission is to protect his client's interests by ensuring that he is able to sell his property without constraint and with clear understanding.

He must ensure that the person has all the necessary information and understands each step of the process. This role goes far beyond simply marketing the property and involves paying special attention to the seller's legal capacity and understanding of the market.

It is also important to show discernment when interacting with older people– being old does not necessarily mean an inability to make decisions. Respecting the dignity and choices of everyone is essential. If there is any lingering doubt about the capacity of an elderly person to sign documents, a legal professional or a trusted relative may step in.

The protection of vulnerable people is based on close cooperation between relatives or legal representatives and real estate brokers. A respectful, attentive, and transparent approach helps ensure that every transaction is carried out ethically and securely in the interests of the person concerned.
