The City of Montréal has published on its website information concerning the approximate location of landfills and old quarries on its territory. Since this is a factor that may affect the value of an immovable, the OACIQ would like to remind brokers of their duty to verify and disclose. Indeed, such a factor must be verified and then disclosed in the Declarations by the seller of the immovable form (especially under clauses D2.15, D3.4, D3.9 and D14.5). In addition, the seller may confirm on the form whether or not he experienced potential contamination issues.

The information reported will protect the seller’s interests by minimizing the risk of legal action against him and enabling buyers to transact with full knowledge of the situation.
