Licence Issue and Maintenance

The purpose of the Real Estate Brokerage Act (REBA) is to ensure the protection of the public in the area of real estate brokerage.
To this end, the Act requires that anyone pursuing brokerage activities in Québec be the holder of a licence issued by the OACIQ.
Real estate brokerage activities are defined in the Act as those of an intermediary who is a party to a real estate brokerage contract for the sale or purchase of a residential or commercial immovable, for remuneration.
Although since 2018 leasing brokerage is no longer exclusive to real estate brokers, all holders of a real estate brokerage licence – issued in Québec or in another jurisdiction – who carry out leasing brokerage transactions are bound by the obligations set out in the REBA. In addition, since December 8, 2021, a holder of a real estate brokerage licence issued by another jurisdiction (Canadian province or foreign country) is required to obtain a licence or special authorization from the OACIQ to carry out leasing brokerage activities in Québec.

It clarifies the OACIQ’s expectations and sets out the practices that are encouraged to ensure licensee compliance. It will help real estate agencies and their executive officers to develop a comprehensive and effective Compliance Program.
