NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON GARRY DALE’S LICENCE

NOTICE is hereby given that Garry Dale, commercial real estate broker (licence H9959), whose establishment is located in St-Laurent has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2) of the Real Estate Brokerage Act.

On April 10, 2024, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Garry Dale’s licence:

 
  1. Within 6 months of his licence issuance, the applicant must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Training Department.
 
  1. Within 30 days of his licence issuance, the applicant shall send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph (a).
 
  1. Within 3 months of his licence issuance, the applicant must take the training course "McGill Personal Finance Essentials" and send proof thereof to the OACIQ Registry Service.
 
  1. For 36 months following his licence issuance, the applicant will be prohibited from carrying on real estate brokerage activities on his own account.
 
  1. For 36 months following his licence issuance, he will be prohibited from carrying on real estate brokerage activities within a business corporation.
 
  1. Within 30 days of his licence issuance, the applicant shall send the Organization’s Registry Service proof that he is acting as an employee.
 
  1. If the applicant wishes to act as a self-employed worker within 36 months of his licence issuance, he shall enter into and maintain a written agreement with the agency within which he carries on his real estate brokerage activities to the effect that the latter retains the GST and QST payable to him, until he is required to remit them upon transmission of his tax return to be kept in the agency's file.
 
  1. In the event of any agency change within 36 months following his licence issuance, he must enter into a new agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
 
  1. The 36-month period shall end only upon the completion of this period with an active real estate broker's licence.
 
  1. The 36-month period shall be suspended in the event the applicant suspends or revokes his real estate broker's licence.
 
Should the applicant fail to comply with the above conditions and restrictions, his real estate broker's licence shall be suspended until he does so.

This notice became enforceable on May 22, 2024.

This notice is given in accordance with section 33 of the Regulation respecting broker’s and agency licences.
