As part of its public protection mission, the Organisme d'autoréglementation du courtage immobilier du Québec is looking for candidates to establish a pool of candidates who are qualified to serve on the OACIQ's committees, i.e. the Inspection Committee, the Syndic Decision Review Committee (SDRC), the Licence Issue and Maintenance Committee (LIMC), the Indemnity Committee and the Discipline Committee.
Required profiles and skills
We are looking for candidates with various profiles, experience and skills, such as:
- Commercial brokerage
- Agency management
- Accounting, finance, taxation, bankruptcy and insolvency
- Ethics and professional conduct
- Internal investigation, compliance, fraud prevention
- Criminology, psychology, social work
- Consumer protection
- Teaching
The selected candidates must be familiar with the real estate brokerage legislative framework and/or possess practical experience in real estate brokerage, have a good command of information technologies, a good capacity for analysis, synthesis and decision-making, good communication skills, show integrity, independence, objectivity and leadership, have public protection at heart and a sense of responsibility.
They must also have an exemplary professional and disciplinary record and impeccable credentials and background check. To this effect, if the application is successful, a professional inspection and verification of the applicant's criminal record will be conducted as part of the recruitment process.
Description of committees
Each committee is comprised of a minimum of three and a maximum of nine members.
Inspection Committee
The Committee makes recommendations based on inspection reports of brokers or agency executive officers. If it notes a violation to the Real Estate Brokerage Act or its regulations, it notifies the syndic.
Syndic Decision Review Committee (SDRC)
The SDRC's duty is to issue an opinion on the Syndic’s decision not to file a complaint with the OACIQ Discipline Committee against the broker or agency targeted by his investigation.
Licence Issue and Maintenance Committee (LIMC)
The LIMC’s mission is to make decisions on licence issue or maintenance where an applicant or licence holder has had his licence revoked, suspended or subjected to restrictions or conditions by the OACIQ Discipline Committee or by another body overseeing real estate brokerage, or was the subject of an assignment of property, a receiving order, a protective supervision of a person of full age or a disciplinary or criminal record related to the performance of brokerage transactions.
Indemnity Committee
The Indemnity Committee’s role is to rule on the eligibility of claims and decide on the amount of compensation to be paid to victims of fraud, fraudulent tactics or misappropriation of funds committed by a real estate agency or broker in the course of a real estate transaction.
Discipline Committee
The Committee hears ethical complaints brought against real estate brokers or agencies and imposes penalties on those found guilty at public disciplinary hearings.
Required availability
Approximately 5-10 sessions are held per year (varies depending on the committee), except for the Discipline Committee which has no maximum. Meetings are held during the day via videoconference or in person. You also need to allow time for preparation before the sessions.
Compensation
Committee members receive attendance fees as compensation. The value of the attendance fees is $560 for a half-day meeting and $880 for a full-day meeting. These fees include preparatory work, which varies in length depending on the committee.
