NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON MÉLANIE BENEZRA’S LICENCE

NOTICE is hereby given that Mélanie Benezra, residential real estate broker, licence number G6865, whose establishment is located in borough St-Laurent  has had conditions and restrictions imposed on her licence following a decision by the Court of Québec, pursuant to section 37 (2) of the Real Estate Brokerage Act.

On June 26, 2023, the Court of Québec concluded that a real estate broker's licence restricted to residential brokerage should be issued to Mélanie Benezra with the following conditions and restrictions:

 

1. Within 6 months of this decision, the applicant must complete the training course: “The broker as a self-employed worker” and provide proof of completion.

2. The applicant will be prohibited from acting on her own account or as agency executive officer for a period of 18 months from the date of this decision;

3. She shall enter into and maintain a written agreement with her agency executive officer, by which the latter undertakes to supervise and oversee her practice for a period of 18 months from the date of this decision;

4. For a period of 18 months from the date of this decision, she shall enter into and maintain a written agreement with the agency within which she carries on her activities to the effect that the latter holds in trust the GST and QST payable to her, as real estate broker, until she is required to remit them along with her tax return;

5. A copy of the agreements mentioned in paragraphs c) and d) shall be sent to the OACIQ within 30 days of this decision;

6. In the event of any agency change during the 18-month period, she must enter into an agreement under the same conditions with the new agency and send a copy thereof to the OACIQ within 30 days following the agency change;
