NOTICE is hereby given that Mr. Sylvain Krief, affiliated real estate agent (Certificate No. B0825) formerly employed by or authorized to act on behalf of S.O.G.I.P., chartered real estate broker (Certificate No. D2982), whose establishment was located at 256 Saint-Louis St. in Lemoyne, has been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offence summarized below:

1st count: During the months of January to August 2004, then main shareholder and sole administrator of 9105-2340 Québec Inc., chartered real estate broker carrying out its activities under the name of S.O.G.I.P.:

a) carrying out the activity of real estate agent and broker without being the holder of a certificate in accordance with the Real Estate Brokerage Act and the Regulations thereunder;

b) acting in a manner that led others to believe that he was authorized to do so;

c) signing several individual transaction registers whereas he was not the representative of this broker for the purpose of the application of the Real Estate Brokerage Act;

thus violating sections 3, 15 and 130 of the Real Estate Brokerage Act, sections 1, 13 and 14 of the Rules of Professional Ethics of the ACAIQ, and sections 130 and 134 (21) of the By-Law of the ACAIQ.

On April 10, 2008, the Discipline Committee ordered a suspension of Mr. Sylvain Krief’s certificate for a period of five (5) years, to be served consecutively to any suspension period currently being served.

The decision of the Discipline Committee is enforceable as of May 20, 2008. The suspension of Mr. Sylvain Krief’s affiliated real estate agent’s certificate will therefore become effective as of November 26, 2017 for a period of five (5) years.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
