NOTICE OF SUSPENSION
of MR. AZZEDINE LAKNIT’S licence

NOTICE is hereby given that Mr. Azzedine Laknit, former real estate broker (licence no. D5470), whose establishment was located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: Between on or around the month of September 2008 and on or around October 23, 2008, concerning an immovable, defendant participated in a scheme to allow promising buyers to apply for a mortgage financing for the acquisition of this immovable, on the basis of false information, notably:

by contacting the representative of the lending institution, and declaring an income for the promising buyers that he knew to be false;
by submitting or allowing to be submitted to the representative of the lending institution documents he knew to be false;

committing, on each of these occasions, an offence under Section 13 of the Rules of Professional Ethics of the ACAIQ. 

2nd count: On or around February 15, 2010, concerning an immovable, made misrepresentations during an investigation conducted by the Assistant Syndic of the ACAIQ, thus committing, on each of these occasions, an offence under Section 55 of the Rules of Professional Ethics of the ACAIQ;

3rd count: Between on or around September 14, 2008 and on or around October 31, 2008, concerning an immovable, participated in a scheme to allow the promising buyer to apply for a mortgage financing for the acquisition of an immovable, on the basis of false information, notably:

by contacting the representative of the lending institution, and declaring an income for the promising buyer that he knew to be false;
by submitting or allowing to be submitted to the representative of the lending institution documents he knew to be false;

committing, on each of these occasions, an offence under Section 13 of the Rules of Professional Ethics of the ACAIQ. 

4th count: On or around February 15, 2010, concerning immovables, made misrepresentations during an investigation conducted by the Assistant Syndic of the ACAIQ, thus committing, on each of these occasions, an offence under Section 55 of the Rules of Professional Ethics of the ACAIQ;

5th count: On or around June 5, 2009, concerning an immovable, signed or had someone sign in lieu of the promising buyer the amendments form and affixed, under these circumstances, his signature as a witness to the signature of the said promising buyer, thus committing an offence under Section 13 of the Rules of Professional Ethics of the ACAIQ. 

6th count: Starting on or around June 5, 2009, concerning an immovable, failed to send without delay to the Manager of the establishment to which he is assigned, the information and documents required to maintain, by the chartered real estate broker certificate’s holder employing him or for whom he is authorized to act, the expected records, books and registers, namely the amendments form,thuscommitting an offence under Section 147 of the By-Laws of the ACAIQ; 

7th count: On or around February 23, 2010, made a misrepresentation during an investigation conducted by the Assistant Syndic of the ACAIQ,committing thus an offence under Section 55 of the Rules of Professional Ethics of the ACAIQ.

On October 18, 2013, the Discipline Committee ordered a suspension of Mr. Azzedine Laknit’sreal estate broker’s licence (licence no. D5470) for total periods of twelve (12) months and six hundred and ninety (690) days on counts nos.1 to 7 of the formal complaint, to be served whenever he becomes a licence holder again.

This notice is given in accordance with Section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
