NOTICE OF SUSPENSION
OF MR. JEAN-FRANÇOIS HOUDE’S LICENCE

NOTICE is hereby given that Mr. Jean-François Houde, former real estate broker (licence no. E7345), whose establishment was located in Montreal, was found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:
1st count: Between on or around the end of March 2010 and on or around April 19, 2010, while his affiliated real estate agent’s certificated was suspended, engaged in brokerage transactions referred to in Section 1 of the Real Estate Brokerage Act concerning an immovable, namely by:
a) contacting a seller to make an appointment for a third party to visit the said immovable;
b) visiting the said immovable with a third party;
d) agreeing with a third party that the latter would give him a portion of the remuneration if the said immovable was the object of a sales transaction;
thus committing, in each instance, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.
2nd count: Between on or around the end of March 2010 and on or around April 29, 2010, concerning an immovable, imitating or allowing someone to imitate the signature of the seller on the brokerage contract;
thus committing an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.
3rd count: On or around September 6, 2011, during an investigation conducted by an assistant syndic, concerning an immovable, falsely declaring that:
a) the seller signed a brokerage contract in his presence;
b) the third party drafted a promise to purchase concerning a prospective buyer;
thus committing, in each instance, an offence under the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.
On May 7, 2013, the Discipline Committee ordered, concerning counts nos. 1 a), 1 b) ,1 d), 2, 3 a) and 3 b) of the formal complaint, a suspension of Mr. Jean-François Houde’s real estate broker’s licence (E7345) for a period of ninety (90) days, to be served as of the expiry of the appeals deadline if he is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.
In addition, the Committee ordered that the suspension periods imposed for counts nos. 1 a), 1 b) and 1 d) be served concurrently with each other, the suspension period imposed on count no. 2 be served consecutively to those of count no. 1, and the suspension periods imposed on counts nos. 3 a) and 3 b) be served concurrently with each other, and consecutively to those of the other counts of the formal complaint.
Given that Mr. Jean-François Houde is no longer a licence holder, his licence will be suspended for a period of two hundred and seventy (270) days whenever he becomes a licence holder again.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r. 3).
