NOTICE OF SUSPENSION OF
MR. MICHEL LÉVY’S LICENCE

NOTICE is hereby given that Michel Lévy, former real estate broker (Licence No. C2435), whose establishment was located in Montréal, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: On or around March 13, 2009, falsely answered “No” to questions 1 and 2 of the form: “Professional Inspection Department – SELF-INSPECTION 2008”, thus committing an offence under section 55 of the Rules of Professional Ethics of the ACAIQ.

2nd count: On or around April 2, 2009, concerning an immovable:

b) entered or allowed to be entered on a description sheet that the date of the signing of a brokerage contract was March 31, 2009, while he knew that this information was inaccurate;
thus committing, on each of these occasions, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: Concerning an immovable, allowed a person other than the prospective buyer to sign in lieu thereof the following documents:

a) on or around May 18, 2009, a counter-proposal;

b) at an unknown date, the form: “Mortgage insurance request”;
thus committing, on each of these occasions, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: Between on or around May 18, 2009 and on or around July 15, 2009, concerning an immovable, sent or allowed someone to send to a mortgage broker documents and/or information he knew or should have known to be false, thus committing an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

5th count: On or around May 13, 2010, as part of an investigation conducted by the assistant syndic, falsely told an investigator:

a) that he had not dealt with the financing steps of the prospective buyer.

b) that the prospective buyer had signed a counter-proposal;

thus committing, on each of these occasions, an offence under section 106 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

6th count: During the fall of 2010, as part of an investigation conducted by the assistant syndic, did not collaborate:

a) on or around October 5, 2010, by refusing to send to an investigator his fee bills regarding some real estate transactions;

b) on or around November 2, 2010, by refusing to send to the assistant syndic documents he had requested in writing on October 25, 2010;

thus committing, on each of these occasions, an offence under section 105 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

On August 5, 2014, the Discipline Committee ordered the suspension of Michel Lévy’s real estate broker’s licence (C2435) for a period of twelve (12) months on counts No. 1, a suspension period of thirty (30) days on count No. 2b), a period of ninety (90) days on each of the counts Nos. 3a), 3b) and 4, a period of forty-five (45) days on each of the counts Nos. 5a) and 5b), a period of sixty (60) days on count No. 6a) and a period of ninety (90) days on count No. 6b).

The suspension periods for counts Nos. 1, 5a), 5b), 6a) and 6b) shall be served consecutively and the suspension periods for counts Nos. 2b), 3a), 3b) and 4 shall be served concurrently.

Given that Michel Lévy is no longer a licence holder, his licence will be suspended for a period of twelve (12) months and two hundred and forty (240) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
