NOTICE OF IMPOSITION OF CONDITIONS ON A LICENCE

Be advised that following the filing of a withdrawal of appeal on June 14, 2018, the decision of the Discipline Committee was enforced. Therefore, the real estate broker licence of Mr. Marcel Matte, whose establishment was located in Brossard, must be subjected to a condition, which obliges Mr. Matte to be supervised from January 11, 2020 to January 11, 2025, by a certified real estate broker with at least 10 years of experience, if he becomes a licence holder again, for committing the following offences:
Count 1: As of September 12, 2014, concerning an immovable, failed and/or neglected to comply with the decision made on February 17, 2014, by the Licence Issue and Maintenance Committee of the OACIQ and in writing on March 13, 2014, which notably ordered that: “his practice be overseen and supervised by the agency for which he is acting, for a period of 18 months.”
Counts 2a) to 2e): As of September 12, 2014, concerning an immovable, did not immediately send to the agency he was acting for the information and documents required to maintain registers and records, i.e. a) the Promise to purchase; b) the Notice of disclosure signed by the seller on September 15, 2014; c) the Counter-proposal; d) the Declarations by the seller of the immovable signed by the prospective buyer on September 15, 2014; and e) the Amendments form.
Count 4: Between September 28, 2014 and on or about October 7, 2014, concerning an immovable, sent or allowed someone to send to a financial institution documents and/or information in support of the prospective buyer’s financing application, while he knew or should have known that these were false.
Counts 5a) and 5b): On or around December 8, 2015, as part of an investigation conducted by the assistant syndic concerning an immovable, falsely stated that a) the prospective buyer had taken care of his mortgage financing process and/or that he was not involved and that b) the prospective buyer had the required sum, i.e. investments for the down payment.
