NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON RYAN LUBELL-SMITH’S LICENCE

NOTICE is hereby given that Ryan Lubell-Smith, real estate broker, licence F0576, whose establishment is located in Pointe-Claire, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (3) of the Real Estate Brokerage Act.

On March 27, 2024, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Lubell-Smith’s licence:
  1. The licence holder shall be prohibited from carrying on real estate brokerage activities on his own account, from the date of notification of this decision until 30 months following the absolute discharge of his bankruptcy.
  2. The licence holder shall maintain a written agreement with the agency on behalf of which he carries on his real estate brokerage activities, to the effect that the latter shall hold the GST/QST payable to him until he is required to remit them, with his tax return to be kept in the agency’s records, from the date of notification of this decision until 30 months following the absolute discharge of his bankruptcy.
  3. The licence holder shall maintain a written agreement with the agency on behalf of which he carries on her real estate brokerage activities, to the effect that the latter shall hold a minimum of 20% of his remuneration for the purpose of paying his income taxes, until remittance is required upon presentation of a copy of his notices of assessment, or for the purpose of paying instalments, from the date of notification of this decision until 30 months following the absolute discharge of his bankruptcy.
  4. A copy of the agreement mentioned in paragraphs b) and c) shall be sent to the OACIQ Registry Service within 30 days following notification of this decision.
  5. In the event of an agency change during the period mentioned in paragraphs b) and c), the licence holder shall enter into an new agreement under the same conditions with the new agency, and send a copy thereof to the OACIQ Registry Service within 30 days following the agency change.
  6. The licence holder shall send to the OACIQ Registry Service the decision of absolute discharge of his bankruptcy as soon as possible.
  7. Should the licence holder not obtain absolute discharge of his bankruptcy by June 30, 2025, his file will be resubmitted to the Committee.

Should Mr. Lubell-Smith fail to comply with the above conditions and restrictions, his right to carry on professional real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

This notice became enforceable on July 16, 2024.
