NOTICE is hereby given that Mr. Richard Ouellette, affiliated real estate agent (Certificate No. D4740), formerly employed by or authorized to act on behalf of Les immeubles du Quartier inc., chartered real estate broker (Certificate No. D8246), whose establishment is located at 220, Montée de la Baie in Pointe-Calumet, has notably been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offences summarized below:
1st count: As of November 15, 2004, with respect to condos to be built, failing to show integrity, committing acts that are derogatory to the honour and dignity of the profession, participating in acts in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely by:
a) imitating his client’s initials under sub-section 4.1 of a brokerage contract for a unit;
b) imitating his client’s initials under sub-section 4.1 of another brokerage contract for another unit;
c) imitating his client’s initials under sub-sections 4.1 and 6 of another brokerage contract for another unit;
d) imitating his client’s initials under sub-section 4.1 of another brokerage contract for another unit;
the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.
2nd count: As of November 15, 2004, with respect to condo units to be built, failing to show integrity, committing acts that are derogatory to the honour and dignity of the profession, participating in acts in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely by leading others to believe that brokerage contracts had been given to his broker through his intermediary, specifically by sending the signed copy of the brokerage contracts to his broker, and by listing these immovables on the MLS service of the GMREB, whereas his client had refused to sign the duplicates of seven brokerage contracts;
the whole contrary to sections 1, 13 and 43 of the Rules of Professional Ethics of the ACAIQ and to section 102 of the By-Law of the ACAIQ.
3rd count: On or around December 17, 2004, with respect to a condo unit, failing to show integrity, committing acts that are derogatory to the honour and dignity of the profession, participating in acts in real estate matters which may be illegal or which may cause prejudice to the public or to the profession, namely by:
a) preparing an Amendments form amending a brokerage contract whereas his client had refused to sign the duplicate of said brokerage contract;
b) imitating his client’s signature on this Amendments form;
the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.
On June 20, 2008, the Discipline Committee ordered a suspension of Mr. Richard Ouellette’s certificate for a period of thirty (30) days on count No. 1 of the complaint, a suspension for a period of sixty (60) days on count No. 2, and a suspension for a period of thirty (30) days on count No. 3, and ordered the suspensions for counts Nos. 2 and 3 to be served concurrently, and together consecutively to the suspension ordered for count No. 1.
The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. July 29, 2008. The suspension of Mr. Richard Ouellette’s affiliated real estate agent’s certificate shall become effective whenever he applies for reinstatement or issuance of any category of certificate, for a period of ninety (90) days.
This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
